Cummings: Ivanka Trump not preserving all official email

President Trump's adviser and son-in-law Jared Kushner used the encrypted messaging service WhatsApp as well as his personal email account to conduct official business, a top House Democrat charged Thursday.

In a letter sent Thursday to White House counsel Pat Cipollone, Cummings accused the White House of "obstructing" his committee's investigation into allegations of violations of federal record laws.

Elijah Cummings said in a letter to White House counsel Pat Cipollone that the panel confirmed late a year ago with Abbe Lowell, personal counsel for Kushner and Trump, that the couple used their personal email and WhatsApp for official business.

According to Cummings, Lowell said that Kushner has been in compliance with the law, and that he takes "screenshots" of communications on his private WhatsApp account and forwards them to his official White House email account or to the National Security Council.

Questions about Kushner's use of WhatsApp comes in the wake of the revelation that Trump previous year directed that his son-in-law receive a top-secret security clearance, despite objections by career intelligence officials.

Lowell also said his discussion with the committee about Ivanka Trump's emails was specifically about the period before September 2017.

Cummings said Lowell told the committee that Kushner's wife, Ivanka Trump, continues to receive emails related to official business on her personal email account but doesn't forward them to an official account unless she replies to it.

The White House didn't immediately respond to requests for comment.


The scrutiny of the couple's communications by the House committee comes after news reports revealed the use of private email accounts and messaging applications as part of their government jobs.

"In fact, as you know, the White House has not produced a single piece of paper to the committee in the 116th Congress - in this or any other investigation", Cummings wrote, referring to the current session of Congress, when Democrats took control of the House.

Cummings also wrote that the House committee, which he chairs, had obtained documents that appeared to show Bannon received messages to his personal email from Barrack about the technology transfer. Numerous emails were allegedly sent in violation of federal records rules, which requires that certain types of emails be sent through government servers for record-keeping purposes. In mid-November, Carol Leonnig and Josh Dawsey reported in the Washington Post that she had sent hundreds of e-mails to aides, Trump cabinet officials and her assistant via a private e-mail address she shares with Kushner.

The committee found that McFarland used an AOL account to discuss the effort pushed by Trump friend Tom Barrack.

A spokesman for Lowell provided Lowell's response to Cummings on Thursday afternoon.

Cummings is asking the White House whether these communications were properly preserved. An attorney for McFarland declined to comment.

In his letter, Cummings pointed out that the White House failed to produce most of the documents requested by the Oversight panel about the use of personal email and messaging accounts by White House officials, as well as records related to other investigations about the administration's immigration policy at the U.S. -Mexico border and hush-money payments made to women alleging extramarital affairs with Trump during the 2016 presidential campaign in exchange for their silence. According to Cummings, when Lowell was asked if Kushner ever communicated classified information on WhatsApp, Lowell responded, "That's above my paygrade".
