Senate Judiciary Committee wraps up Kavanaugh hearing

Regarding your editorial "The Kavanaugh Hazing" (Sept. 4): The Democrats charge that Judge Brett Kavanaugh plans to elevate executive power over power of the legislature and judiciary and therefore will be inclined to protect President Trump if Robert Mueller's investigation concludes that Mr. Trump committed a crime. Democratic Sen. Cory Booker of New Jersey - who along with Harris is a potential presidential candidate in 2020 - said he was willing to risk fallout over releasing confidential documents about Kavanaugh's views on race. But after two marathon days in the witness chair in a Senate hearing room, Kavanaugh appeared on his way to becoming the court's 114th justice.

Kavanaugh did answer a lot of questions in a number of key areas, including abortion, gun rights, and special counsel Robert Mueller's Russian Federation investigation.

If you want proof that our system is broken, you need only look at today's hearing on the nomination of Brett Kavanaugh to the Supreme Court, where children who aren't old enough to vote testified against the nominee.

She said that because Kavanaugh lied about the stolen material three times under oath, he should be rejected for the Supreme Court and removed from his current bench. Kavanaugh said that the comment did not reflect his personal views, but "what legal scholars might say".

"I was born at night but not last night", Leahy said, "and if I found I had something that somebody said "we've stolen this" or "don't tell anybody we have this" - I think it would raise a red flag".

The White House, which is determined to have Kavanaugh confirmed before the November elections as Republicans aim to deliver on Trump's priorities, applauded the schedule announcement.


"I always wait until after the hearings are complete before making a decision, and I'll do so in this case as well", she told The Associated Press in an interview. "But, we are trying to create a national pressure against the confirmation", Menendez said.

Sen. Cory Booker of New Jersey asked Kavanaugh whether he would recuse himself from a case involving the special counsel Robert Mueller or the Russian Federation probe if the nation's high court takes up the matter. Utah Republican Sen. Mike Lee had hinted Wednesday that the documents would come out, saying there was "no reason" to keep them private.

Leahy's charge stems from an infamous episode between 2001 and 2003 when a Republican counsel on the Senate Judiciary Committee, Manuel Miranda, learned that Democrats on the panel had put documents on a computer server shared with Republicans.

One of the 12-page email chains that Booker ultimately provided showed that, in 2002, Kavanaugh wrote that he "generally" favored racially neutral security measures in the long term.

Separately, an email written to Kavanaugh by a then-staffer to the Republican leadership, Barbara Ledeen, had the subject line "spying".

"A religious drug treatment center should be no better - but also no worse - in the eyes of the government than a non-religious drug treatment center", Kavanaugh wrote, by way of arguing that the Constitution requires that faith-based organizations should not receive preferential treatment, but should still receive a "neutral" and fair shake.

Kavanaugh, whose hearings were swarmed with protesters from various activist groups opposed to his nomination, revealed a trove of information about himself, while concealing just as much.

Kavanaugh demurred on the issue: "If I committed to deciding a particular case. all I would be doing is demonstrating that I don't have the independence of the judiciary".
