In the spring, Ottawa announced the purchase of Kinder Morgan's core Canadian assets for $4.5 billion to take ownership of the existing pipeline.
Notley says she spoke Prime Minister Trudeau following the Federal Court of Appeal's ruling and demanded that the federal government immediately launch an appeal to the Supreme Court of Canada.
"We need to look at ensuring that environment oversight is absolutely paramount and a cornerstone of any project development across this country".
"Meaningful consultation is not intended simply to allow indigenous peoples "to blow off steam", the decision said".
"We believe this project is in the national interest, we believe that it's critically important for our economy, critically important to allow us ... to get to worldwide markets", said Morneau.
Both North Shore First Nations have been adamantly opposed to the pipeline project, and have criticized the federal government for not adequately consulting them. "That is extremely alarming".
The decision "quashed" the government's 2016 approval of the pipeline, which was based upon on those flawed consultations, the court ruled.
The court combined into one case almost two dozen lawsuits calling for the energy board's review to be overturned.
Finance Minister Bill Morneau said in a tweet that the federal government is reviewing the decision. Knaak says while media reports are distilling the court's decision into a couple of paragraphs, it's actually made up of 200 pages.
The court found that the government's representatives "limited their mandate to listening to and recording the concerns of the Indigenous applicants and then transmitting those concerns to the decision-makers".
The Squamish Nation cheered the ruling as a recognition of Indigenous rights.
Politicians and business leaders in the River City are expressing feelings of anger and disappointment following this morning's federal court ruling on the Trans Mountain pipeline. "Alberta has done everything right and we have been let down", Notley said. "We won!" said Chief Lee Spahan, of the Coldwater Indian Band, at a press conference in Vancouver.
"The big takeaway is the duty to consult (indigenous people) is still the most important step in any major project", Leach said.
Earlier Thursday, the Federal Court of Appeal overturned Ottawa's approval of the pipeline, which would have doubled the line from Edmonton to the B.C. coast and tripled the amount of oil shipped to fetch a better price on overseas markets. It would also increase the number of tankers in Burrard Inlet sevenfold.
"The unjustified exclusion of marine shipping from the scope of the project led to successive, unacceptable deficiencies in the board's report and recommendations", Dawson wrote, noting that the Governor in Council "could not rely on the board's report and recommendations when assessing the project's environmental effects and the overall public interest".
"The National Energy Board did not consider the impacts to the whales which would be a violation of the Species at Risk Act", said Chris Genovali, Executive Director of the Raincoast Conservation Foundation.
This cost the Liberals on questions about their government's economic stewardship, its vaunted Indigenous reconciliation, its climate strategy and the competence of the federal cabinet. When asked if the pipeline project is dead, he said it will no longer be "top of mind for British Columbians". Our job was defending BC interests and respecting the rule of law.
January 30, 2018: B.C. government moves to restrict any increase in diluted bitumen shipments until it conducts more spill response studies, a move that increases the uncertainty for Trans Mountain.
Vancouver Mayor Gregor Robertson said the decision validates his city's concerns about marine impacts and Indigenous consultation.
Horgan campaigned against the pipeline before taking office and, afterward, continued to speak on his government's concern about possible oil spills and his determination to protect the province's coastlines, waterways and land.
