France to set age of sexual consent at 15 after rape outcry

After two rape cases involving 11-year-old girls became highly publicized, France has proposed introducing a legal age of sexual consent in the nation.

It would be a first for France, which does not now have an age of consent.

The move was welcomed by France's equality minister, Marlène Schiappa.

Currently, prosecutors must prove sex with someone under 15 was forced in order to bring rape charges.

In the United Kingdom the age of sexual consent is 16, but children under the age of 13 have additional legal protections that declare they can never consent to sexual activity. This carries a maximum sentence of five years in prison and a fine of €75,000 (£66,000; $87,000).

Speaking previously Schiappa said: "The law will mean that "below a certain age, there can be no debate, ever, on the sexual consent of a child, and that any child below a certain age would automatically be considered as raped or sexually assaulted".


Schiappa said she was "very glad" the country's government had chosen the age as 15, as recommended by a panel of doctors and legal experts - an age that has been long sought by associations fighting violence against children.

Last November, a french court acquitted a 30-year-old rape after it determined that his 11-year-old victim had not been subjected to "constraint, threat, violence or surprise".

In a separate case, a 29-year-old man was originally told he should not face charges of rape because there was no evidence the 11-year-old was coerced.

Schiappa told reporters she was "very glad" that the government chose to formalize the age of consent, a move that she hopes will combat the prevalence of rape culture in France. President Emmanuel Macron met his future wife, Brigitte, when he was around 14 and she was 38 and a teacher at his school.

But last month the court reversed course and said the man should indeed face rape charges, though it asked for the trial to be moved to a higher court.

Once approved by Parliament, the new law is expected to go into effect within the next few weeks as part of a broader package of laws aimed at reducing sexual violence and harassment.
